ACCESS PROCEDURE TO THE LABOUR MARKET

 

The work permit is the official document, realised according to the law and is giving the owner the right to be hired or to be detached in Romania to a single employer.

The work permit is realised by request to foreigners by the Labour Force Migration Office, public institution under the authority of the Ministry of Labour, Social Solidarity and Family.

 

The work permits that could be granted to foreigner citizens are the following:

-          for working, type A (permanent workers),

-          for working, type B (detached workers),

-          for working, type C (seasonal workers),

-          for working, type D (probation workers),

-          for working, type E (sportsman),

-          for working, type F (nominal),

-          for working, type G (tran-frontier workers).

 

The period of time necessary to apply for realising the work permit

 

The request for realising the work permit is submitted within the right to stay given thru the working visa or thru the long staying visa for other purpose but not late than 10 days after the expiring of the validity.  

 

In case of not granting the work permit, the Labour Force Migration Office has the obligation to communicate in written the decision’s reasons to applicant.    

         

In 10 days after the realising of the work permit, the employer has the obligation to conclude an individual labour contract on limited period of time for the alien citizen only for the period of time stipulated by the work permit.

 

The employer has the obligation to register the individual labour contract to the territorial labour inspectorate in the term stipulated by the law.

 

In 7 days after you were hired on an individual labour contract on limited period of time the alien have the obligation to ask for the temporary residence permit from Aliens Authority.

 

Employer or work permit owner non-attendance for getting the work permit from the Labour Force Migration Office in 30 days from the favourable solving of the request, in due time, determined the cancelling of the work permit by the OMFM. 

 

 

VISA, AUTHORIZATION TO WORK, ETC.

 

If you plan to live and work in Romania, you will need to acquire a work permit. This process requires an effort from both your Romanian employer and you.
